Here’s what actually happened for gun owners this week:
The City of Akron got sued over posted firearms bans at Lock 3 Park, including during the city festival, after a Cuyahoga Falls man took the City to court under Ohio’s statewide preemption law, because cities do not get to invent their own gun rules, hang a sign, and dare you to challenge it. Local politicians keep testing that, and if they think gun owners won’t push back, they’ll keep pushing.
DOJ’s under-21 handgun window is still the biggest federal story this week, because DOJ said it may not criminally punish dealers for selling handguns to otherwise law-abiding adults ages 18 to 20, and this week’s follow-through is ATF still reviewing what that means day to day plus talk of a negotiated resolution in related litigation. There is no final settlement, Congress left the statute on the books, and Ohio’s own under-21 handgun rules are still in effect.
The Fifth Circuit punched a hole in interstate handgun rules too. In the Elite Precision case, a panel struck the federal framework that blocks buying handguns across state lines, and you can celebrate the crack without declaring the dam gone, because the mandate has not issued. Industry guidance still says do not treat out-of-state over-the-counter handgun sales as open for business, and background checks and prohibited-person rules still stand.
